FATHER OF THREE KILLED IN NEGLIGENT HUNTING INCIDENT; WIDOW AND FAMILY REPRESENTED BY THE POTTS LAW FIRM
The Potts Law Firm filed suit on behalf of Widow Monica Fancher on Friday, March 9th against Roy Anton Eppeland and John Doe of Palestine, Texas to recover damages for the wrongful death of her husband, Jacob Marshall Fancher. Jacob Marshall Fancher was the father of three young children.
On November 12, 2016, Jacob Marshall Fancher was visiting a ranch in Palestine, Texas for a hunting party when he was negligently and recklessly shot and killed with a firearm by Roy Eppeland. Defendant John Doe is the owner of the property where the shooting and death occurred, and will be served when his identity is discovered.
A duty of care is a legal obligation enforced on individuals to adhere to a standard of reasonable care while participating in or performing acts that could foreseeably harm others. Defendant John Doe had a duty of care to not create unreasonably dangerous conditions for the general public and guests who visit his ranch and operate firearms. Likewise, defendant Roy Eppeland had a duty of care to properly operate firearms or shoot in the direction of another person when the deadly force is unjustified. The breach of each duty of care resulted in the death of Jacob Marshall Fancher. Civil shooting cases are becoming increasingly common, and they are necessary for bereaved families to seek justice against those involved in negligent shootings.
The attorneys for the Fancher family, Micah Dortch and Maryssa Simpson, stated the following: “The Fancher family has suffered the loss of a husband and father because of the reckless use of a firearm. The criminal Grand Jury did not look kindly upon Mr. Eppeland for the shooting of Jacob Marshall Fancher, and we expect that a civil jury will not look kindly upon anyone who participates in or aids reckless or ignorant behavior with guns.”
The venue for suit is Anderson County, Texas, the same county where the shooting took place.
