Emily played a significant role in one of the largest mass tort litigations in U.S. history—the Combat Arms Earplug litigation against 3M Company. In that litigation, which involved claims brought by tens of thousands of veterans and U.S. military servicemembers, Emily was a key member of trial teams responsible for multiple landmark verdicts against the 3M Defendants, including a $55 million jury verdict in federal court in Florida.

Throughout the course of the 3M litigation, Emily second-chaired critical depositions of corporate representatives and company employees whose testimony became central evidence used in trials throughout the litigation. She also played a major role in trial and trial preparation, including development of expert testimony, plaintiffs and fact witness depositions and trial testimony, and strategy for opening and closing arguments.

Emily has extensive courtroom and discovery experience in complex litigation. She has handled more than 300 depositions as first-chair counsel, including depositions of corporate representatives, expert witnesses, treating physicians, and key fact witnesses. Her work frequently involves coordinating large discovery efforts, analyzing extensive electronic discovery records, and novel trial strategies and case themes in matters involving millions of documents and complex scientific evidence.

In addition to her national mass tort practice, Emily has obtained significant results for individuals, businesses, and public entities in complex litigation arising from catastrophic losses, sexual assaults, insurance disputes, business disputes, and otherwise.

Emily has represented clients from all walks of life—from veterans, to teachers, to social media influencers, business executives, cryptocurrency companies, school districts, and real estate moguls. Emily makes her clients her top priority—she is known for treating her clients like they are friends, and providing honest case evaluations, regular updates, diligent preparation for depositions and trial, and working hand-in-hand to ensure that her clients feel like they can trust her to best handle their case.

Emily currently manages Potts Law Firm’s complex national litigation dockets involving emerging mass torts and catastrophic injuries. Her recent work includes litigation involving the negative impact of social media platforms on youth and teen mental health; representation of male water polo players sexually assaulted by their high school coach; mesh product injuries; and otherwise, with defendants including major technology companies such as Meta Platforms and Snap, Inc., Boston Scientific, 3M Company, University of Southern California, State Farm, and more.
