Nissan’s Faulty Emergency Braking System

A defective emergency brake class action lawsuit was filed on February 15th, 2022 against Nissan alleging that models with the Continental ARS410 sensors cause the vehicles to abruptly slam on the brakes even though there are no objects in proximity. It also alleges the system suddenly deactivates without warning rendering the safety system useless.

Three Nissan owners are suing and alleging that the car company had long been aware of the false activations for “years before it put the first Class Vehicles on the market” and are continuing to market the FEB system specifically as safe and reliable. There has been no action to warn or fix these vehicles. There have been recalls for the issue in Canada and Asia, yet Nissan has yet to issue a recall in the U.S.

WHAT IS THE FEB (FORWARD EMERGENCY BRAKING) SYSTEM?
The FEB system is meant to use radar sensors to detect obstacles in front of vehicles. If detected, the system should alert the driver and if the driver does not respond in time, the brakes are triggered.

According to Nissan, “[T]his intelligent feature uses radar technology to monitor a vehicle’s proximity to the vehicle ahead, giving the driver audible and visual display warnings to help the driver reduce the vehicle’s speed if a potential frontal collision is detected. If the driver fails to respond, the [Forward Emergency Braking] system can apply the brakes, helping the driver to avoid the collision or reduce the speed of impact if it is unavoidable.”

However, many Nissan owners have noted their FEB warning light turns on and activates the system for no apparent reason detecting nonexistent obstacles. There have also been instances of the FEB system being triggered by inclement weather conditions.

  • 2019-2021 Murano
  • 2020-2021 Titan
