Welcome to Potts Law Firm (“the Firm,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our website, communications, and related offerings, including SMS/text messages, email, phone, and other platforms (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, please discontinue use immediately.

1) No Attorney–Client Relationship Created by Website Use
Using this website or communicating through web forms, chat, SMS, or email does not create an attorney–client relationship.
An attorney–client relationship is formed only after you and Potts Law Firm execute a signed written engagement agreement.
Do not send confidential information until such a relationship has been established.
2) Eligibility and Lawful Use
You must be 18 or older (or the age of majority in your jurisdiction) to use the Services.
You agree not to misuse, disrupt, or interfere with the Services, and not to use them for any unlawful purpose.
We may restrict or terminate access at any time for violations of these Terms.
3) Electronic Communications & SMS/Text Terms (A2P 10DLC/TCPA)
By submitting your information, you consent to receive communications from us related to your inquiry, potential representation, and service updates. Additional SMS terms:
a) Opt-In Method (Unchecked Checkbox).
You may opt in to SMS/text messages by entering your mobile number on our website and checking a dedicated, unchecked consent box next to the phone field. The disclosure at sign-up states:
“I agree to receive recurring informational and promotional text messages from Potts Law at the number provided. Messages may include appointment confirmations, reminders, service updates, feedback requests, and promotional offers. Message frequency may vary. Msg & data rates may apply. b) Message Types.
Appointment confirmations and reminders, day-of notifications, reschedule notices, service updates, feedback requests, and occasional promotions related to Potts Law services. Links may be included for appointment management or more information.
c) Frequency & Charges.
Message frequency varies by interaction. Message and data rates may apply.
d) Opt-Out / Help.
Reply STOP to opt out at any time. You will receive one additional message confirming your opt-out. For assistance, reply HELP or email [email protected].
e) Consent Not a Condition.
Your consent to receive SMS messages is not a condition of purchase or legal services.
f) No Third-Party Lists.
We do not use purchased or third-party contact lists; we only message numbers that provided direct consent.
g) Mobile Information & Sharing (Required Clause).
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except as necessary to provide the SMS services (e.g., with text messaging platforms, aggregators, or subcontractors acting on our behalf to deliver messages).
h) Number Ownership & Changes.
You represent that you are the current owner or customary user of any phone number you provide. If you change, port, or deactivate your mobile number, you agree to promptly notify us at [email protected] to prevent messages from being sent to someone else.
i) Carrier & Delivery Disclaimers.
Delivery of messages is subject to effective transmission by your mobile carrier and compatibility of your device; carriers are not liable for delayed or undelivered messages.
j) E-SIGN Disclosure & Consent.
By using the Services, you consent to receive communications and records electronically (including via SMS/email). You may withdraw electronic consent by emailing [email protected]; doing so may limit your ability to use certain features.
4) Privacy Policy
Your privacy is important to us. Our collection and use of personal data are governed by our Privacy Policy, which is incorporated into these Terms. By using the Services, you consent to our data practices.
5) Scheduling, Appointments & Follow-Ups
Appointments may be confirmed, rescheduled, or canceled via SMS/email/phone. We may send reminders and follow-ups as described in Section 3. Attendance, timeliness, and any preparation requirements are your responsibility.
6) Intellectual Property
All content on the website (text, graphics, logos, images, and software) is the property of Potts Law Firm or its licensors and is protected by intellectual-property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.
7) Third-Party Services & Links
The Services may link to or integrate with third-party websites or providers (e.g., hosting, analytics, email/SMS delivery). We are not responsible for third-party content, policies, or practices. Your use of third-party services is subject to their terms.

9) Limitation of Liability

You agree to indemnify and hold harmless Potts Law Firm, its attorneys, employees, and affiliates from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your misuse of the Services or violation of these Terms.
11) Governing Law & Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Any dispute shall be brought exclusively in the state or federal courts located in Harris County, Texas.
12) Changes to Terms
We may update these Terms at any time. Updates will be posted here with a revised “Last Updated” date. Your continued use of the Services after an update constitutes acceptance of the updated Terms.
